BorderShop

  1. Scope

    1. These General Terms and Conditions (“GTC”) apply to all sales contracts between Heinemann TRFB GmbH, Zur Westmole 1a, 23769 Puttgarden (“Seller”), and consumers (“Buyer”) who purchase goods at the BorderShop.

      The Seller’s offer is directed exclusively at consumers within the meaning of Section 13 of the German Civil Code (BGB). Sales to dealers or resellers do not take place.

    2. Deviating or supplementary agreements are only valid if they have been expressly confirmed in writing by the Seller. These Terms and Conditions take precedence over such agreements unless expressly provided otherwise.
    3. German law applies exclusively, to the exclusion of international private law and the UN Convention on Contracts for the International Sale of Goods (CISG).
    4. Mandatory statutory provisions apply regardless of whether they are mentioned in these Terms and Conditions, provided that these Terms and Conditions do not contain any deviating or excluding provisions.
  2. Product Presentation, Reservation, and Conclusion of Contract

    1. Through the Seller’s Click & Collect webshop, Buyers may select goods and reserve them without obligation for pickup at the BorderShop. The presentation of the goods on the website does not constitute a binding offer, but merely an invitation to make an offer (invitatio ad offerendum).
    2. The purchase contract is concluded exclusively at the BorderShop when the buyer pays for the goods and the seller accepts the payment.
    3. A reservation does not entitle the buyer to the conclusion of a purchase contract. If the reserved goods are not picked up no later than 24 hours after the agreed pickup time, they will be made available for sale again.

      The reservation must generally be made at least 3 hours before the scheduled pickup time.

      The reservation is provided as a voluntary service by the seller. Prior to payment and handover of the goods, no contractual claims exist, in particular no claims for delivery or damages.

  3. Prices, Currencies, and Retention of Title

    1. Payment in the BorderShop can be made in euros (EUR) or Danish kroner (DKK).
    2. The goods remain the property of the seller until full payment has been made.
  4. Place of Performance, Transfer of Risk, and Rights in Case of Defects

    1. The place of performance is the pickup location selected at the time of reservation. You may choose between the BorderShop Puttgarden (Zur Westmole 1a, 23769 Puttgarden, Germany) or the BorderShop Rostock (Zum Südtor 5, 18147 Rostock, Germany).

      Orders may only be picked up at the selected pickup location.

    2. Risk passes to the buyer upon delivery of the goods.
    3. The buyer is entitled to the statutory rights regarding defects pursuant to Sections 437 et seq. of the German Civil Code (BGB).
  5. Information pursuant to the BattG

    We are legally obligated to inform you as follows:

    Batteries and rechargeable batteries must not be disposed of with household waste. You can return used batteries or rechargeable batteries to us by mail or return them free of charge at a location near you.

    Batteries containing more than 0.0005% mercury, 0.002% cadmium or 0.004% lead are marked with the chemical symbols Hg, Cd, Pb.

  6. Shoplifting

    Any instance of shoplifting will be reported to the authorities. We reserve the right to charge a processing fee of €150 for every proven case of shoplifting.

  7. Final Provisions

    Should any provision of these Terms and Conditions be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.

    The invalid provision shall be replaced by the statutory provision that most closely approximates the economic purpose.
